Unlawful Credit Card Charges

The default credit card charges, according to consumer law, are only meant to cover the actual costs of late payment or exceeding the card limit. Credit card companies cannot impose fines or levy charges over and above this level.

But that is precisely what’s been happening. When the Office of Fair Trading carried out an investigation in 2006, it concluded that fees above £12 were unfair and unreasonable. Consequently, most credit card companies have lowered their charges to £12.

However, on the basis that most credit card charges have been almost three times this amount (on average £30-£35), the OFT have recommended that individuals are entitled to claim from their credit card provider the difference between £12 and what they were in fact charged. We on the other hand can act on your behalf to claim back not only the difference, but the entire amount charged. These claims can be backdated up to six years and include interest payable by the credit card company from the date the charges were debited.
